You paid the VAT on a laptop, a software subscription or a business dinner. Then your gestor (the accountant or advisory firm that files your taxes) tells you it can't go in your quarterly VAT return. In Spain, the right to deduct VAT depends on the paperwork as much as on the expense, and Hacienda (the Spanish tax authority, AEAT) checks the paperwork.

What does an invoice need for you to deduct VAT in Spain?

You need an original invoice that meets every requirement of Spain's invoicing regulation, Royal Decree 1619/2012. Article 97 of the VAT Act (Ley 37/1992, "LIVA") says a document that fails any requirement does not support a deduction unless it is corrected. You also can't deduct more VAT than the amount shown separately on the invoice, and the expense must be used for your business (art. 95 LIVA).

A full invoice (factura completa) must include the items in article 6 of RD 1619/2012:

FieldWhy it matters
Invoice number and seriesNumbers must be consecutive within each series
Issue dateSets the period and starts the deadlines
Full name or company name of supplier and customerThe invoice must identify you as the buyer
NIF of supplier and customerFor normal purchases from Spanish businesses, your NIF (tax ID) is mandatory
Address of supplier and customerPart of identifying both parties
Description, taxable base and unit price before VATShows the expense relates to your business
VAT rateLets anyone check the VAT amount
VAT amount shown separatelyYou can only deduct VAT shown this way
Date of the supply, if different from the issue dateDetermines when VAT is due
Exemption or "inversión del sujeto pasivo" note, where relevantExplains why no VAT was charged

A supplier invoicing another business has until the 16th of the month after the supply to issue the invoice (art. 11 RD 1619/2012).

Can I deduct VAT with a receipt or simplified invoice?

Not with an ordinary receipt (ticket). A simplified invoice (factura simplificada, art. 7) only has to show the seller's details, the VAT rate and the total. Shops may issue one up to 400 euros including VAT, and up to 3,000 euros in sectors such as retail, restaurants, hotels, passenger transport, hairdressers, parking and toll roads (art. 4).

To deduct, the document must also show, at your request as a business:

  • your NIF,
  • your address,
  • the VAT amount, shown separately.

So ask for a factura completa when you pay. Give your NIF (for foreign residents it is usually your NIE) and your address, and ask for the VAT to be itemised. If you only have the receipt, ask the seller for a full invoice with your details as soon as possible.

What if the invoice has the wrong name or NIF?

You can't deduct the VAT until the supplier sends a corrected invoice. Common cases: the invoice is in your personal name while your SL (limited company) paid, or in the SL's name while you paid as an autónomo (self-employed), a digit of the NIF is wrong, or you ordered from a personal online account with no tax ID on the invoice. None of these meets article 6, and article 97 LIVA blocks the deduction until it is fixed.

Ask the supplier for a corrective invoice (factura rectificativa) with the right details. You deduct the VAT in the period you receive it or later, within the four-year limit.

Can I deduct VAT on invoices from foreign suppliers?

Usually you deduct VAT that you declare yourself, not VAT the supplier charges. When a business not established in Spain supplies a service to you, you are the person liable for the VAT (art. 84.Uno.2º LIVA). This is the reverse charge (inversión del sujeto pasivo): the invoice comes without Spanish VAT, you report the VAT as due in modelo 303 (the quarterly VAT return) and deduct the same amount if the expense is fully deductible. The net effect is often zero, but both lines must be there.

Where it goes wrong:

  • An EU supplier charges you its own VAT, for example Irish or German VAT. That VAT never goes into your 303. Give the supplier a valid EU VAT number so it treats you as a business.
  • An invoice from an EU supplier must meet the requirements of article 226 of the EU VAT Directive (art. 97.Uno.4º LIVA), which include your VAT number and a reverse charge note.
  • For goods imported from outside the EU, the document that supports the deduction is the customs import settlement, not the supplier's invoice.

If you also sell to EU clients, read how to invoice EU customers.

How long do I have to deduct VAT?

Four years from when the right to deduct arises, which is generally when the VAT became due (arts. 98 and 99.Tres LIVA). After that the right expires (art. 100). VAT counts as incurred when you receive the invoice (art. 99.Cuatro), so you can deduct it in that quarter or any later one within the four years.

See Spanish tax deadlines and late surcharges for when each return is due.

Which expenses have limited or no VAT deduction?

Even with a perfect invoice, the law restricts some expenses.

  • Cars. Passenger cars and motorbikes are presumed to be 50% business use (art. 95.Tres.2ª LIVA). The same applies to fuel, parts, repairs, parking and tolls (art. 95.Cuatro). 100% is presumed only in listed cases, such as mixed vehicles carrying goods, paid passenger transport, driving schools and sales agents. To deduct more than 50% you must prove actual use; your return or accounts are not enough.
  • Meals, travel and hotels. VAT is deductible only if the cost is deductible for income tax (IRPF) or corporate tax (art. 96.Uno.6º).
  • Gifts and hospitality for clients, staff or third parties: not deductible, except free samples and low-value promotional items (art. 96.Uno.5º).
  • Other exclusions: jewellery, food, drink and tobacco, shows and leisure services (art. 96.Uno).
  • Personal expenses: anything for private use is not linked to your business (art. 95).

How do I fix a wrong invoice?

The supplier issues a factura rectificativa (art. 15 RD 1619/2012). It is mandatory when the original invoice misses any requirement of articles 6 or 7, or when the VAT was calculated wrongly. It must be issued as soon as the error is known and within four years of the VAT becoming due. It goes in its own series and must identify the invoice it corrects.

  1. Email the supplier with the invoice number, date and the wrong data.
  2. Check the corrective invoice references the original.
  3. Record it and deduct the VAT in the period you receive it.

Do not edit the PDF yourself. A document changed by the customer is not a valid invoice.

Frequently asked questions

Can I deduct VAT from a restaurant receipt in Spain?

Not from a plain receipt. You need a full invoice, or a simplified invoice showing your NIF, your address and the VAT amount separately. Even then, restaurant VAT is deductible only if the meal is a deductible expense for income tax or corporate tax.

Does the invoice need my NIF to deduct VAT?

Yes, for normal purchases from a Spanish supplier. Article 6 of RD 1619/2012 requires the customer's NIF for supplies made in Spain by a business established there. Without it, ask for a factura rectificativa.

How much VAT can I deduct on my car?

Generally 50%, because Spanish law presumes half business use. A 100% presumption applies only to listed cases such as goods transport in mixed vehicles, taxis, driving schools and sales agents. You can deduct more than 50% only if you can prove the real business use.

I forgot to include an invoice in my 303. Is the VAT lost?

No. You can deduct it in a later quarter, as long as four years have not passed since the VAT became due.

Why can't I deduct the VAT an EU supplier charged me?

Because it is another country's VAT and it does not belong in your Spanish return. For most business services, if you give a valid EU VAT number, the supplier invoices without VAT and you apply the reverse charge. If it already charged VAT, ask it for a corrective invoice.

How Fiscalm helps

Many of these problems take one email to fix if you catch them the day the invoice arrives, not three months later. Fiscalm collects invoices from your email (Gmail) and bank statements (Santander, Wise), reads them with AI and checks them against more than 20 rules: NIF validated with the AEAT, EU VAT numbers with VIES, the mandatory fields of a factura completa, VAT maths, reverse charge, vehicle expenses and duplicates. It matches every bank movement to its invoice and lists what is missing.

You get a tax calendar with amounts, a box-by-box draft of modelo 303, VAT record books in AEAT format and a quarterly package for your gestor (see the quarterly document checklist). Fiscalm does not file returns. A private beta opens in November 2026 with 20 founder places, free during the beta.
