Terms of use
The rules of the Fiscalm service: what it does and does not do, the beta, bank and third-party connections, your data and our responsibilities.
Who provides the service
Fiscalm is a service of ATIEMPO.ME SL, Spanish tax ID (NIF) B56542111, contact hola@fiscalm.app. By creating an account or using Fiscalm you accept these terms for yourself or for the company you represent. The Spanish version is the binding one.
What Fiscalm is
A tool for freelancers, companies and accounting firms in Spain that gathers invoices, payslips and bank transactions, sorts them with the help of artificial intelligence, matches them against the bank, checks tax IDs and VIES, shows the tax calendar and prepares draft returns.
Fiscalm is not a substitute for a tax adviser. Drafts and notices are aids: reviewing, filing and paying each return is the responsibility of the taxpayer or their accountant. Fiscalm does not file returns on your behalf unless you expressly switch that on once the feature exists.
Private beta
During the beta the service is free, by invitation and with limited places. It may change, have bugs or interruptions, and no service level is guaranteed. Before any paid plans we will tell you in advance and you can decide whether to continue.
Accounts and access
- Sign-in is by invitation, with an email link or a passkey. Keep your device and mailbox secure.
- The company decides who has access and with which role, and is responsible for what they do with it.
- Tell us immediately about any unauthorised use.
Acceptable use
You may not use Fiscalm for unlawful activities, upload third-party content without a legal basis, try to access other companies’ data, test security without written permission, overload the service or resell it without an agreement.
Third-party connections
- Banks: through Enable Banking Oy, an authorised account information service provider (PSD2). Access is read-only: Fiscalm cannot move money. Consent is given on the bank’s website, lasts at most 180 days and can be withdrawn at any time.
- Wise, Gmail, Zoho Invoice, Telegram and the AEAT certificate: switched on with a button and can be disconnected whenever you like. Keys are stored encrypted.
- Those services have their own terms; Fiscalm is not responsible for their outages or API changes.
Your data
The data you upload or connect belongs to your company. You can export all of it at any time and delete the company from the app. How we process personal data is explained in the Privacy policy.
Data processing (Art. 28 GDPR)
For personal data the company uploads or connects, the company is the controller and ATIEMPO.ME SL is the processor. We undertake to:
- Process the data only to provide Fiscalm and on the company’s instructions, which are these terms and what it configures in the app.
- Ensure that people with access are bound by confidentiality.
- Apply the security measures described in the privacy policy.
- Use only the sub-processors listed in the privacy policy, and give notice before adding others so the company can object.
- Help the company respond to data subject requests and meet its security and breach-notification duties, informing it of any breach without undue delay.
- When the service ends, delete the data (or return it through the export) unless the law requires us to keep it.
- Provide the information needed to demonstrate compliance.
Liability
We provide the service with professional diligence. To the extent permitted by law, we are not liable for indirect damage, lost profits, penalties arising from returns not reviewed by the taxpayer or their accountant, or failures of banks and third-party services. Nothing in these terms limits liability for wilful misconduct or gross negligence, or the rights the law gives consumers.
Leaving
You can stop using Fiscalm and delete your account or company at any time. We may suspend an account that breaches these terms or puts other users at risk, with notice where possible.
Changes
We will announce meaningful changes at least 15 days in advance. If you do not agree, you can leave before they apply.
Governing law
These terms are governed by Spanish law. Disputes will be settled by the courts that have jurisdiction under the law; if you are a consumer, those of your place of residence.
